Power of Attorney

A Power of Attorney designation may be used in place of a person designating an authorized representative if the designation allows representation in the health care application or eligibility process.

Question icon. What is a Power of Attorney?

A Power of Attorney, per the EPM, is a legally binding document that authorizes a person or corporation to act on another person’s behalf in financial matters. The powers granted can be limited to certain activities and to a specific time frame or they can be general and wide in scope. (EPM 1.3.1.2)

The document must be dated, signed by the client and include the name of the person or corporation who is being appointed to act on the client’s behalf.

Power of Attorney Terminology:
You will encounter these terms when checking the Power of Attorney:

Principal: The person granting the power of attorney (the client.)

Attorney-in-Fact: The person or corporation acting on the principal’s behalf.

Durable Power of Attorney: A designation by the principal that shows intent to allow the Attorney-in-Fact to continue even if the principal becomes incapacitated.
