Minnesota and North Dakota Interstate Agreement

There is an interstate agreement between Minnesota and North Dakota regarding placement of a person entering a skilled nursing facility (SNF) in the other state.

A person residing in North Dakota who enters a Minnesota SNF, or a person residing in Minnesota who enters a North Dakota SNF, remains the original state’s financial responsibility for 24 months or longer, depending on whether there is a community spouse living in the placing state.

This agreement does not apply to any other type of living arrangement or receipt of waiver services. More information regarding the agreement is found in the EPM.
