Became Incapable of Indicating Intent Before Age 18
A person who meets the following characteristics prior to age 18 is considered to be incapable of indicating intent: Has an I.Q. of 49 or less. Has a mental age of seven or less. Is determined incompetent by a court or is found incapable of indicating intent by a psychologist, physician, or developemental disabilities professional.
