Allocation Amount
Below is a list of situations when the income allocation amount may differ from the calculated amount:
- When the LTC spouse does not have enough income to allocate the full amount, the allocation will be less than the calculated amount. In these cases the allocation amount is as much as the LTC spouse’s income will allow.
- When the allocation amount is not enough to cover the community spouse’s monthly needs due to exceptional or unusual circumstances. You may be able to approve a temporary increase in the allocation amount while the community spouse takes steps to resolve the situation. More information about this situation is found in the EPM.
- When a court order for spousal support is more than the community spouse income allocation amount, and the couple is still married. Use the court-ordered amount.
