Annuity Transfer Evaluation

Once you have determined that the transfer evaluation requirement must be applied, you must then evaluate the annuity to determine if an uncompensated transfer occurred.

Evaluate an annuity to determine if an uncompensated transfer occurred when all of the additional conditions listed below are met and no exceptions apply. These are also listed on the Annuity Transfer Evaluation (PDF) handouts.

• The annuity was purchased with the funds of the person requesting MA-LTC.

• The person requesting MA-LTC is a payee under the annuity contract.

• An MA-LTC annuity transaction occurred.

  An MA-LTC annuity transaction is a qualified action taken (by an annuity owner) on an annuity that occurs within the lookback period or while the client is an MA-LTC enrollee.

  
  
• The annuity is in the annuitization phase.
