Notice of Privacy Practices ( Minn. Statute § 13.04, subd. 2 and 45 CFR §164.520 )

The Data Practices Act and the Health Information Portability and Accountability Act (HIPAA) give people certain rights to both protect and have access to data an agency collects, maintains, uses and disseminates.

Whenever people are asked to provide private or confidential information about themselves, the county agency must give them a "Notice of Privacy Practices." This notice has also been called the "Tennessen Notice," "Practices Rights Statement" or "Privacy Act Notice."

The Notice of Privacy Practices describes why information is being collected and who will have access to it. Because the Notice of Privacy Practices identifies who will have access, counties do not have to get other written consent from to disclose the data to persons listed on the Notice of Privacy Practices.
