Notifying person of eligibility decision
Counties and the state are required by law to provide notice any time a change is made to services. This can be a reduction, suspension, denial or termination of services. Notices of action must be in writing and sent at least ten days before actions are to take effect.
Federal and state law gives persons the right to fair hearings when they disagree with county, state or health plan decisions about their human services benefits, payments or services. A ppeal hearings must be requested in writing within 30 days after receiving written notice about a county or state decision (or up to 90 days if good cause for the delay is demonstrated).
The Appeals and Regulations Division of the Department of Human Services hears and decides these appeals.
