Pre-Death Liens

A pre-death lien
Definition icon.EPM Definition: A legal right of interest that a creditor has in another person's property until the creditor's claim has been repaid or the lien expires.
is a means for the State of Minnesota to recover the cost of MA paid on behalf of a client at the time real property is sold or when the client dies. Pre-death liens are filed by the DHS Special Recovery Unit against a homestead and other real property owned by certain MA-LTC enrollees.

To determine whether a pre-death lien must be filed, follow the steps found on the Pre-Death Liens (PDF) handout.
