Condition 4

The fourth condition that must be met to evaluate an annuity using the annuity transfer evaluation process is that the annuity is neither assignable nor revocable.

Note: If the annuity is assignable or revocable, the value of the annuity is an available and counted asset.

Example:

Justin, an MA enrollee is requesting MA-LTC. Justin’s annuity contract specifies that his annuity is not assignable and he cannot gain access to it until it is annuitized.

Action:

Determine that condition 4 is met.
