Condition 2: It is not known if this condition is met because only Keisha (Dexter’s spouse) is designated as a beneficiary and it is unknown if someone other than Keisha can be named. Consider the condition met and, if necessary, it will be confirmed during the designation process.

Condition 3: No, this condition is not met. An MA-LTC annuity transaction did not occur because a qualified action has not occurred during the lookback period.

Do not require Dexter to name DHS as the preferred remainder beneficiary because all three conditions are not met. Another evaluation of whether any new MA-LTC annuity transactions have occurred must be completed at each renewal.
