Who is a Spouse?
Before you can determine whether a client has a community spouse, you must first know the definitions to the terms used in this determination.
For health care program eligibility, marriage must be a union that is legally recognized in Minnesota. This includes a person who is legally separated or not living with their husband or wife regardless of the length of the separation. If you have questions as to whether a union is legally recognized in Minnesota, check with your county attorney or submit a HealthQuest.
