Identifying the Community Spouse
You would think that the spouse of a person meeting the definition of an LTC spouse is automatically the community spouse; however, this is not the case. You must determine if the spouse of an LTC spouse qualifies as a community spouse.
The spouse of an MA-LTC client is a community spouse if that spouse does not reside in an LTCF or receive services through any of the waiver programs and is the spouse of a person meeting the definition of an LTC spouse.
A community spouse may be eligible for a Minnesota Health Care Program or receive services through the Alternative Care program and still qualify as a community spouse.
