Assets Allowed for Protection

Assets owned by the client, in whole or in part, are allowed to be protected through the LTCP.

Exceptions:
Do not allow these assets to be protected:

A special needs trust.

A special needs trust is a trust established for the needs of a person with a disability. It must meet very specific criteria in order for it to be considered this type of trust. More information can be found in the EPM.

A pooled trust.

A pooled trust is one trust funded by separate accounts for disabled beneficiaries of the trust. The trust “pools” the accounts. Again, more information about this type of trust can be found in the EPM.

• Certain annuities.

• Any portion of an asset owned by another person. Submit a HealthQuest to request a determination of the portion of the asset the client owns when the client owns the asset jointly with another person.
