Value Exceeds PAL

The value of the asset the client is choosing to protect may exceed the Protected Asset Limit (PAL). The difference between the value of the asset and the protected amount is either counted or excluded based on the asset type and MA asset policy. Below are two situations that result in a client protecting assets that exceed the PAL.

Multiple Protected Assets.

Bao resides in an LTCF and is requesting MA payment of LTC services. $10,000 in benefits has been paid from her Partnership policy. Bao is choosing to protect a certificate of deposit valued at $25,000.

Bao is allowed to protect $10,000 of the CD. Count the remaining $15,000 in her asset total. Bao’s total counted assets are over the asset limit. She must reduce her counted assets following MA policy to be eligible for MA-LTC.

Reminder icon. Remember! A client must be given the opportunity to reduce excess assets following basic MA policy.
