County of Financial Responsibility (CFR)

You must determine the correct county of responsibility for your MA-LTC clients. The following will help you in determining the correct county of financial responsibility:

Whether the client resides in an excluded time facility
Excluded time facilities include, but are not limited to, hospitals when the stay is for 30 days or more, LTCFs, board and lodging facilities, RTCs. See the Eligibility Policy Manual for a more extensive list.
or receives excluded time services.

Excluded time services include, but are not limited to, receipt of services from a Semi-Independent Living Service (SILS) Program paid by MA. See the Eligibility Policy Manual for a more extensive list.

Where the client lived prior to admittance to the excluded time facility or receiving excluded time services.

The county of financial responsibility is the county in which the client lived immediately before entering the excluded time facility or receiving excluded time services.

Exception: The county of financial responsibility for a client who moves from another state (without being placed by another state) directly into a Minnesota LTCF is the county in which the LTCF is located.

Example:

Erma requests MA-LTC through the CADI waiver while residing in a GRH in Blue Earth County. Prior to entering the GRH she lived in St. Peter which is in Nicollet County.

Action:

Nicollet County is Erma’s county of financial responsibility because it is the county in which she lived prior to entering the excluded time facility. Blue Earth County may service her case.
