Residence of Spouse or Child
An LTCF resident’s homestead may be excluded as long as it is the residence of the LTCF resident’s spouse, child under 21 or disabled child of any age. If the spouse or child moves out of the homestead, the homestead exclusion no longer applies.
Use the MA definition of disability to determine if the LTCF resident’s child is disabled. Verify the disability has been certified by SSA (or SMRT if the child is an MHCP enrollee). It does not matter at what age the child became disabled.
