Answer the following questions about the Step 2 sub-steps.

1. True or False; a transfer penalty is established when an applicant or enrolleet is not cooperating with designating DHS as the PRB of an annuity.

False, a period of ineligibility is established, not a transfer penalty. The length of the period of ineligibility for non-cooperation with an annuity requirement is calculated in the same way a transfer penalty is calculated, but they are coded differently on the MMIS RLVA screen. A transfer penalty is a period of ineligibility, but the reason for the ineligibility is due to an uncompensated transfer of income or assets.

2. True or False; basic MA is closed when an enrollee requesting MA-LTC does not cooperate with designating DHS as the PRB of an annuity.

False, basic MA remains open but the request for MA-LTC is denied. To deny the request for MA-LTC send a DHS-4915 and add a worker comment to any MAXIS notice. And don’t forget to code the MMIS/RLVA screen with the period of ineligibility!
