Section Summary
You have now walked through the process of designating DHS as the PRB. The general steps, if everyone cooperates and responds timely, are as follows:
- Determine the annuity meets the three conditions to require the owner to designate DHS as the PRB.
- Send DHS-3271, with the DHS-5036, requesting the owner(s) sign and return the form in 10 days.
- Send the DHS-5037, with the original of the signed DHS-5036, to the annuity issuer. Request the issuer to return the completed form in 30 days.
- Review the returned DHS-5037 and send a copy of it to DHS Special Recovery Unit when DHS has been designated as the PRB of the annuity.
