Yes, Magnolia may allocate income to her daughter because Magnolia’s daughter is under age 21 and lives with the community spouse.

Question 2.

No, Hester may not allocate income to her son because he does not live with a community spouse. A child must be under age 18 when not living with the community spouse in order to receive an allocation.

Note: Hester is using an LTC income calculation because she is SIS-EW. If she was EW (non-SIS-EW) she would be using a community income calculation because she does not have a community spouse. An allocation is not allowed in a community income calculation.

Question 3.

Yes, Hugo may allocate income to his son because his son is under age 18 and it does not matter whether or not he resides with the community spouse.

Question 4.

Yes, Al may allocate income to his sister because his sister is living with the community spouse and is considered a tax dependent.

Question 5.

No, Felicia cannot allocate income to her daughter because an LTC income calculation is not being used to determine her MA-LTC eligibility.

Remember! All people who are receiving services through a disability waiver use a community income calculation.
