Beginning/Ending the Community Spouse Income Allocation

Before jumping into the calculation used to determine the allocation amount, let’s take a minute to discuss when to start and stop allowing the allocation.

Beginning the community spouse income allocation.

Begin using the community spouse income allocation deduction either when:

Use of an LTC income calculation begins, or
The LTC spouse begins allocating the calculated amount to the community spouse after the LTC income calculation has already begun.

Allow the allocation when there is a community spouse at any time in the month.

Ending the community spouse income allocation.

Example:

Brian resides in an LTCF. His wife, Dorothy, resides in the community and receives a community spouse allocation from Brian’s income. Dorothy enters an LTCF on January 10.

Action:

Do not allow the community spouse income allocation on Brian’s LTC income calculation for February (the first full month of Dorothy’s LTC residence).
